Abstract

Attracting foreign patients to local healthcare institutions will be beneficial for increasing the profitability of hospitals and national economic development, as well as improving the national image of Korea. It will provide an excellent opportunity to demonstrate the high quality of Korean medical services to the rest of the world, and in addition to the medical profession, the government has also been making efforts to develop the medical industry. However, since providing medical services involves the risk of medical accidents, it is necessary to be prepared in case of any legal disputes. In the event of a medical accident involving a foreign patient, the main problems relate to the jurisdiction of the foreign patient¡¯s home country, as well as the large amount of potential damages and legal costs. Through the use of standard contracts, jurisdiction and arbitration agreements, and medical insurance, efforts should be made to prevent the occurrence of risks that threaten the existence of medical institutions.
